The Problem

The SSA office isn't always right. Your client, and your reputation, is paying the price.

Social Security rules are dense, interconnected, and frequently misapplied — even by SSA employees. When a client acts on incorrect guidance, the financial damage compounds every single month for the rest of their life.

Until now, verifying the correct answer required countless hours on the phone with the Social Security Administration, hours researching POMS, or an expensive consultation. AXIOM makes that expertise available on demand, for any scenario, in seconds.

The Solution

Ask AXIOM. Get the answer, grounded in federal law.

I have a client who is 62 and considering filing early. Her husband is 64 and is the higher income earner and is not planning to file until FRA. The Social Security office is telling her that she will still benefit from a full spousal boost, even if she claims early and her own benefit is reduced. Is this accurate?
A
× Incorrect — The advice is incorrect because the client will not receive a full spousal boost if she files at age 62.

The advice given to the client requires clarification. If the client files for her own Social Security retirement benefits at age 62, her retirement benefit will indeed be reduced because she is filing before her full retirement age (FRA). However, the computation of benefits is based on two separate records: her own and her husband’s.

If the client becomes eligible for spousal benefits at her FRA, the spousal portion of her benefit will not be reduced, even though her own retirement benefit was reduced due to early filing. This means that while her personal retirement benefit is reduced for early filing, the spousal benefit she receives when she reaches FRA will be calculated without reduction, based on her husband’s primary insurance amount (PIA) (RS 00615.500).

Therefore, the client will receive a full spousal boost when she becomes eligible for the spousal benefit at her FRA, despite having claimed her own reduced retirement benefit early.

The Cost of Getting It Wrong

Acting on incorrect SSA guidance costs your clients — permanently.
